Refusing an offer of accommodation

Step 1

If you refuse a Final Offer you must do so in writing stating your reasons.

If we agree with you that the offer is not reasonable, we will make you another offer. However, you may have to wait several weeks or months.

If you consider that the Final Offer is not suitable, you have the legal right to ask for a review of our decision. You should do this in writing, stating your reasons, within five working days of receiving the offer.

Step 2

The review will be undertaken by a Senior Officer not involved in your case. If the Senior Officer confirms that your refusal was unreasonable, but you still disagree, the matter will be referred to local Members if available, or to the Cabinet Member for Housing.

If a local Member or Cabinet Member for Housing considers that the offer was suitable, you will be re-offered the property.

Step 3

If, after review by a local Member or Cabinet Member for Housing, you do not accept the re-offer within five working days, we will have fulfilled our homelessness duty towards you under the Housing Act 1996 (as amended).

We will confirm this in writing within 21 days of your original refusal of the offer, or within 21 days of your second refusal if you asked for a review.

You will be asked to leave any temporary accommodation we may have provided and your housing application will be re-assessed based on your current housing circumstances.
